Engendering regulation of artisanal and small-scale mining: participation, protection and access to justice

This article argues that adopting a gender perspective when regulating artisanal and small-scale mining (ASM) is both necessary achievable. The authors analyse women’s often-ignored needs experiences as workers, decision-makers affected community members in the ASM sector. To address these concerns, this sets out standards for to guarantee access services information decision-making representation; specific risks women face sector; provide effective remedies. use international instruments identify good practice benchmarks from which legislators policymakers can draw. also notes where global norms fall short of addressing rights ASM. Some limitations approach are acknowledged, notably challenge establishing gender-responsive laws be feasibly effectively implemented.
